Please read these terms of service carefully before using our website or membership services.

1. Agreement to Terms

By accessing our website (kacp.co.ke), registering for membership, or utilizing any KACP digital services (including forums, event portals, and resource libraries), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and professional regulations in Kenya.

These terms apply to all members, prospective members, event attendees, website visitors, and other users of KACP services.

2. Membership, Accounts & Professional Conduct

KACP membership is a privilege granted to qualified Clinical Pathologists and related professionals.

  • Accurate Information: You must provide accurate, complete, and current professional information during registration and keep your member profile updated.
  • Account Security: You are responsible for safeguarding your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
  • Professional Ethics: Your use of KACP platforms and services must align with the highest standards of medical ethics and professional conduct as outlined by the Kenya Medical Practitioners and Dentists Council (KMPDC).
  • Membership Dues: Continued membership is contingent upon the timely payment of annual dues as stipulated for your membership category.
Important Notice

Misrepresentation of professional qualifications or unethical use of member forums may result in immediate suspension or termination of membership without refund.

3. Intellectual Property Rights

All content on the KACP website and member portals—including text, graphics, logos, clinical guidelines, protocols, syllabi, and scientific materials ("KACP Content")—is the property of KACP or its licensors and is protected by copyright and intellectual property laws.

  • Member License: Members are granted a limited, non-exclusive, non-transferable license to access and use KACP Content for personal, non-commercial professional development.
  • Restrictions: You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any KACP Content without our express written permission.
  • User Contributions: By posting, sharing, or submitting content (e.g., forum posts, case studies) to our platforms, you grant KACP a perpetual license to use, display, and distribute that content for the Association's educational and operational purposes.

4. Prohibited Activities

You agree not to use KACP services to:

Violate any applicable national, professional, or ethical laws or regulations.
Post or share confidential patient information, defamatory, harassing, or misleading clinical content.
Use the member directory for unsolicited commercial communications (spam), marketing, or recruitment without consent.
Attempt to circumvent security, scrape data, or overload our systems.
Impersonate another member, KACP official, or any other person.

5. Events, CPD & Payments

Registration for conferences, workshops, and CPD events is subject to specific event terms and fees.

Key Terms:

  • Payment: Event fees must be paid in full by the stated deadline to secure your registration.
  • Cancellation & Refunds: Cancellation policies are event-specific and will be communicated during registration. Refunds, if applicable, may be subject to an administrative fee.
  • CPD Certificates: Certificates of attendance/participation are issued upon verified completion of the event requirements.
  • Program Changes: KACP reserves the right to alter event programs, speakers, or venues as necessary.

6. Professional & Educational Disclaimers

KACP is a professional association, not a direct healthcare provider or regulatory body.

  • Clinical Guidelines & Content: All scientific content, guidelines, and forum discussions are for informational and educational purposes only. They are not a substitute for professional clinical judgment, diagnosis, or treatment.
  • "As Is" Basis: Our services and content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
  • No Guarantee: We do not guarantee the accuracy, completeness, or timeliness of information on our platforms, nor continuous, uninterrupted, or secure access to our services.

7. Limitation of Liability

To the fullest extent permitted by Kenyan law, KACP, its officers, trustees, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, membership, or attendance at events, including but not limited to loss of data, loss of profits, or interruption of practice, even if advised of the possibility of such damages.

8. Termination

We may suspend or terminate your membership and access to our services immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other members or the Association, or is unlawful. Termination may result in forfeiture of any paid membership dues.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of KACP services shall first be addressed through good-faith negotiation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of KACP services after such changes constitutes your acceptance of the new Terms.

Members will be notified of significant changes to the Terms of Service via their registered email address.
